What to Expect in the Probate Process
New Jersey probate follows a structured process:
- Filing: An executor or administrator petitions the court to open the estate
- Court Appointment: The court appoints the executor or administrator
- Notice & Creditor Claims: Creditors and beneficiaries are notified; creditors have a period to file claims
- Asset Collection: The estate collects accounts, property, and other assets
- Debt Payment: Debts, taxes, and administrative expenses are paid from estate assets
- Distribution: Remaining assets are distributed to beneficiaries according to the will or NJ law
- Account & Discharge: The executor files an accounting with the court and is discharged from responsibility
The timeline varies based on estate complexity, but probate typically takes 9–18 months in New Jersey.
Guardianship
Guardianship is a court process that appoints someone to manage the affairs of a person who can no longer do so themselves—due to age, mental incapacity, or disability. If a family member needs guardianship, I help you petition the court, navigate the legal requirements, and establish the guardianship relationship. This protects your loved one while ensuring their affairs are handled responsibly.
Estate Litigation
Sometimes disagreements arise during probate. A beneficiary may dispute the will. An executor's conduct may be questioned. Property or accounts may be claimed by multiple parties.
